1. Acceptance of Terms

By accessing or using the PairRide mobile application and related services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including riders, drivers, and any other individuals who access or use the platform.

2. Description of Service

PairRide is a ride-hailing platform that connects riders with drivers. Our Service includes:

• Matching riders with available drivers
• Facilitating ride bookings and payments
• Providing real-time ride tracking
• In-app communication between riders and drivers
• Wallet and payment management features

PairRide acts as an intermediary platform and does not provide transportation services directly. Drivers are independent contractors, not employees of PairRide.

3. User Accounts

3.1 Account Registration

To use our Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Eligibility

• You must be at least 18 years old to use the Service
• You must have the legal capacity to enter into binding agreements
• Drivers must possess a valid driver's license and meet all local requirements
• Drivers must maintain valid vehicle registration and insurance

3.3 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

4. User Responsibilities

4.1 Riders

Riders agree to:

• Provide accurate pickup and drop-off locations
• Be present at the pickup location at the scheduled time
• Treat drivers with respect and follow all applicable laws
• Pay all charges for rides completed
• Not engage in any illegal activities during rides

4.2 Drivers

Drivers agree to:

• Maintain a valid driver's license and vehicle registration
• Carry adequate insurance coverage
• Provide safe, reliable transportation services
• Follow all traffic laws and regulations
• Treat riders with respect and professionalism
• Not discriminate against riders based on protected characteristics

5. Payment Terms

5.1 Pricing

Ride prices are calculated based on factors including distance, time, demand, and applicable fees. Prices are displayed before you confirm your ride booking. We reserve the right to modify pricing at any time.

5.2 Payment Methods

We accept various payment methods including credit cards, debit cards, and in-app wallet balances. By providing payment information, you authorize us to charge your payment method for all rides and applicable fees.

5.3 Refunds

Refund requests will be reviewed on a case-by-case basis. Refunds may be issued for cancelled rides, service issues, or other circumstances at our sole discretion.

5.4 Platform Fees

PairRide may charge platform fees or service fees, which will be clearly disclosed before you confirm your ride. Drivers may be subject to commission fees on completed rides.

6. Cancellation Policy

Riders may cancel rides before the driver arrives without penalty. Cancellation fees may apply if:

• A rider cancels after a driver has already arrived at the pickup location
• A rider repeatedly cancels rides
• A driver cancels after accepting a ride (subject to driver penalties)

Cancellation fees will be clearly communicated before being charged.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose
• Harassing, threatening, or abusing other users
• Impersonating another person or entity
• Interfering with or disrupting the Service
• Attempting to gain unauthorized access to the Service
• Using automated systems to access the Service without authorization
• Violating any applicable laws or regulations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAIRRIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

PairRide is not responsible for the conduct of riders or drivers. We do not guarantee the availability, quality, or safety of transportation services provided by drivers.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to PairRide in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless PairRide, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the Service

10. Intellectual Property

The Service and its original content, features, and functionality are owned by PairRide and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written permission.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PairRide operates, without regard to its conflict of law provisions.

12.2 Dispute Resolution Process

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

1. Good faith negotiations between the parties
2. Mediation, if negotiations are unsuccessful
3. Binding arbitration, if mediation is unsuccessful

You agree to waive any right to a jury trial and to participate in class action lawsuits.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced with a valid, enforceable provision that comes closest to the intent of the original provision.

15. Entire Agreement

These Terms constitute the entire agreement between you and PairRide regarding the use of the Service and supersede all prior agreements and understandings.
